Review of Queensland's biodiscovery legislation

Call for submissions closed

The Queensland Government has commissioned an independent review of the Biodiscovery Act 2004 (Qld) and calls for submissions that address the review's terms of reference.

The Biodiscovery Act 2004 (Qld) (the Act) commenced by proclamation on 12 November 2004.  The legislation provides streamlined, sustainable access to the State's native biological resources for the purposes of biodiscovery whilst returning a fair and equitable benefit to the State, for the benefit of all Queenslanders.  These objectives are achieved through a regulatory framework for taking and using native biological resources, a contractual framework for benefit sharing, a compliance code and collection protocols, and monitoring and enforcement provisions.

Section 121 of the Act stipulates that the Ministers responsible for administering the Act must review it within five years of commencement to decide whether its provisions remain appropriate.
